Over the past few years it has come to my attention that NICA denies ever paying for Parental & Custodial Care of the child. I can say without a doubt that is not the truth. In late December of 2002 my Attorney that I had retained as representation informed NICA that we were seeking reimbursement for Noah's care. Remember that the new legislation was signed by the Governor in June off 2002 and Noah had passed away March of 2002. We were asking to be reimbursed for all the time Noah was in our direct care with exception to when he was at Caring Hearts Prescribed Pediatric Extended Care or when he was under the direct care of a Nurse when Jill and I may have gone out for the evening. NICA responded within thirty days with an offer of just over $20,000. We informed NICA that the offer was unacceptable and was seeking reimbursement for 20,821.50 hours. NICA agreed and reimbursed us at a rate of $10.00 per hour consistent with previous cases.
